Fair planning for the Deferred Lands

WUFA supports responsible environmental protection while advocating for planning controls that are fair, evidence-based and consistently applied.

Why this matters

The proposed Northern Beaches Local Environmental Plan and Development Control Plan will determine how land within the Deferred Lands may be used and developed for decades to come.

WUFA supports the protection of genuine environmental values. The planning framework must also preserve legitimate existing rights, rely on verified evidence and treat comparable land consistently.

Three principles

Fairness

Existing rights, approvals and legitimate expectations should be respected.

Evidence-based planning

Environmental zoning and mapping should be supported by reliable, site-specific evidence.

Consistency

Comparable land and land uses should be treated consistently throughout the Northern Beaches.

Ten recommendations

Fairness

1

Retain existing permissible land uses

Existing lawful planning opportunities should not be removed without compelling evidence and a fair transition.

2

Reinstate the two-year transition period

Landowners should have a reasonable opportunity to lodge applications under the controls on which they have relied.

3

Recognise approved boarding houses and seniors housing

Existing approvals and lawful development should be clearly recognised by the new planning framework.

4

Protect existing dwelling rights

The new LEP should preserve established dwelling entitlements and avoid creating uncertainty for landowners.

5

Extend Additional Uses Area 11

The additional-use area should include all logically connected Forest Way properties and expressly permit suitable established uses.

Evidence-based planning

6

Require evidence-based C3 zoning

Conservation zoning should be based on verified site-specific environmental evidence.

7

Use consistent minimum lot sizes

Minimum lot sizes should reflect contemporary evidence and the actual development pattern.

10

Ensure riparian land mapping is evidence-based

Waterway, wetland and riparian controls should apply only where the mapped environmental feature actually exists.

Consistency

8

Correct R5 and RU4 land-use tables

Comparable rural-residential land should have practical and internally consistent permissible uses.

9

Apply special controls fairly

Scenic, environmental and local controls should be justified and applied consistently across comparable land.
